Permitted Use Policy
About This Policy
1. Welcome to Pixleaks. This Permitted Use Policy (“Policy”) applies to all users of the Pixleaks Online Platforms. It
governs the ways in which you may access and use the Pixleaks Online Platforms and Content, and it establishes
certain restrictions on the types of Content that may be uploaded, shared, or otherwise made available through the
Pixleaks Online Platforms.
2. You should carefully review this Policy and revisit it periodically, as it may be updated or amended from time to
time. Your continued use of the Pixleaks Online Platforms constitutes your acknowledgment and acceptance of the
terms of this Policy.
3. Capitalized terms used in this Policy have the meanings assigned to them in the Definitions section. Terms such as
“include” or “including” are illustrative and not intended to limit the generality of the surrounding language.
Prohibited Uses
4. You must not use any Pixleaks Online Platforms or Content, nor upload, submit, post, create, host, or otherwise make
available any material that contains, provides access to (including through third-party links), or promotes any of
the following categories of content or activities:
a. Adult Content: Material that is sexually explicit, pornographic (including nudity or sexual activity), or that
promotes commercial services associated with adult activities, such as escort services.
b. Exploitation of Minors: Material that seeks to harm, exploit, or depict children in any manner that encourages or
promotes sexual or other inappropriate interest in children.
c. Hate Speech and Discrimination: Material that endorses, incites, or condones violence, hatred, or discrimination
based on race, ethnicity, religion, disability, age, gender, nationality, sexual orientation, or gender identity.
d. Incitement of Violence: Material that threatens, encourages, or is intended to provoke violence, or that may
cause physical or psychological harm to any individual or group.
e. Harassment: Material that involves harassment, bullying, stalking, or any form of threatening conduct toward any
individual or group.
f. Defamation: Material that contains false statements about a person that could damage their reputation or subject
them to public contempt or ridicule.
g. Infringement of Third-Party Rights: Material that violates intellectual property rights, including copyright,
trademark, patent, trade secret, or data privacy rights of others.
h. Offensive Content: Material that would reasonably be considered offensive, including “shock value” content
intended to provoke outrage.
i. Fraudulent, Misleading, or Deceptive Conduct: Material that contains false, misleading, or deceptive statements,
representations, or disinformation.
j. Promotion of Regulated or Illegal Goods and Services: Material that promotes or facilitates the supply of
prohibited or restricted products or services, including weapons, gambling, or similar activities.
k. Illegal Activities: Material that violates any applicable law or regulation, or that promotes, instructs, or
facilitates unlawful conduct.
l. Activities Harmful to Pixleaks or Others: Material that could cause damage to Pixleaks, its Pixleaks Affiliated
Companies, or others. This includes, without limitation, pirated software, unauthorized programs, malicious code
(including viruses, trojans, and malware), or content designed to gain unauthorized access to systems, networks, or
user data.
m. Use of Content for Artificial Intelligence or Machine Learning: The use of the Pixleaks Online Platforms or
Content for training, developing, or enhancing artificial intelligence models or machine learning algorithms,
directly or indirectly, is strictly prohibited. Unauthorized use for such purposes constitutes a material breach of
this policy and may result in immediate suspension or termination of access, as well as legal action.
Enforcement
5. We reserve the right to take action under this policy with respect to any conduct or material that, in our sole
discretion, is inconsistent with the intent and principles of this policy—even if such conduct is not explicitly
listed above. If your actions are substantially similar to, or have the same effect as, prohibited activities
described herein, we may act as though such conduct were expressly prohibited.
Community Engagement
6. Pixleaks is built upon the principles of a good community, and like any well-functioning and healthy community,
certain behaviors are strictly prohibited. Accordingly, it is NOT PERMITTED to:
a. Attempt to gain unauthorized access to any computer systems, networks, or Content through the Pixleaks Online
Platforms;
b. Attempt to contact other Members via the Pixleaks Online Platforms, or use any information obtained from the
Pixleaks Online Platforms or its Content, for the purpose of arranging private transactions that would otherwise be
conducted through the Pixleaks Online Platforms;
c. Enter into any agreements or arrangements that are inconsistent with, or intended to supplement or circumvent,
the specific User Terms and rules applicable to the use of each Pixleaks Online Platforms;
d. Use information obtained from the Pixleaks Online Platforms or its Content in a manner that may mislead, confuse,
or deceive third parties (for example, collecting information to establish a website that imitates or misrepresents
itself as the Pixleaks Online Platforms);
e. Use, or authorize the use of, any device, program, automated script, or process to monitor, copy, extract, or
scrape all or any portion of the Pixleaks Online Platforms; and/or
f. Attempt to disrupt, interfere with, negatively affect, or otherwise alter the proper functioning of any Pixleaks
Online Platforms in any manner.
Investigation and Incident Reporting
7. To protect our community, we use a mix of automated tools and human moderation to detect, assess, and address any
Content or activity that may breach this policy or other Pixleaks terms and guidelines.
8. Moderators carefully examine any Content flagged by automated systems and investigate reports submitted by users.
You agree to cooperate fully with Pixleaks in any investigation or resolution of potential violations.
9. Illegal Content can be reported by submitting a ticket in our Help Center. Other reports of unacceptable use or
Content should be emailed to report@pixleaks.com. All reports are reviewed by our moderation team
10. Reports from government or law enforcement authorities are treated in the same manner, with priority given to
entities designated as “trusted flaggers” under the EU Digital Services Act (DSA), as required by law.
Enforcement and appeals
11. Pixleaks reserves the sole discretion to determine whether any use of the Pixleaks Online Platforms or any Content
constitutes a violation of this Policy. In assessing whether a violation has occurred, Pixleaks may consider,
without limitation, the following factors:
a. the total quantity of unacceptable Content uploaded or the number of baseless notices or complaints submitted;
b. the proportion of Content or notices deemed unacceptable relative to the total;
c. the severity and consequences of the violation;
d. the intent of the recipient, individual, entity, or complainant; and
12. Should Pixleaks determine that your use of the Pixleaks Online Platforms, or any Content or activities associated
with your account, breaches this Policy, Pixleaks may, at its sole discretion and without prior notice or liability,
and without prejudice to any other remedies available, take any of the following actions:
a. require you to remove, delete, or disable access to the relevant Content on the Pixleaks Online Platforms;
b. remove, delete, or disable access to the Content, limit or restrict its visibility, or implement any other
measures pertaining to the Content;
c. suspend or terminate any accounts or agreements you hold with Pixleaks and/or restrict your access to any
Pixleaks Online Platforms, either temporarily or permanently;
d. discontinue provision of any services, including website hosting;
e. in cases of significant concern, including but not limited to child exploitation or other illegal activity,
report the matter to the relevant authorities; and/or
f. implement any combination of the actions set forth above.
13. Suspension or termination of your access to the Pixleaks Online Platforms or your Pixleaks account may result in the
forfeiture of Content licenses, as well as any associated Content and memberships.
14. Pixleaks will respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright
Act (DMCA). Details regarding our policies on intellectual property infringement claims can be found here.
15. Pursuant to the Digital Services Act (DSA), European users of the Pixleaks Online Platforms have the right to
challenge moderation decisions made by online platforms. If you disagree with a decision made under this Policy, you
may submit an appeal within 180 days by submitting a ticket in our Help Center.
16. Should you be dissatisfied with the outcome of an appeal, you may pursue further resolution through an out-of-court
settlement or by initiating legal proceedings. Under the DSA, EU Member States are required to designate certified
out-of-court dispute resolution bodies for such matters, which will be publicly listed on a website maintained by
the European Commission. Decisions rendered by these certified bodies are non-binding on you or Pixleaks.
17. If you are uncertain as to whether your Content or intended use of our services complies with this Policy, please
contact Pixleaks for guidance.
Definitions
The Pixleaks Online Platforms: The Pixleaks digital platforms, encompassing all features, functionalities, websites,
software, Photos, and other content associated with those platforms, or any successor or related sites.
Pixleaks Affiliated Companies: Pixleaks and any entity that controls, is controlled by, or is under common control with
Pixleaks. References to a Pixleaks Affiliated Company include any successors (whether by merger, acquisition, or
otherwise) and any permitted assigns.
User, you, or your: Any individual who accesses or uses the Pixleaks Online Platforms, regardless of whether they are a
Photographer, Member, or Buyer.
Content: Any information, materials, data, digital photography that are uploaded, posted, submitted, shared, or
otherwise made accessible on or in connection with any Pixleaks Online Platforms.
