Pixleaks’ Role

Pixleaks functions as the service provider of the Pixleaks Online Platforms for both Regular Users and Photographers. All photography available on our platforms are uploaded directly by the respective Photographers. When Pixleaks receives claims regarding unauthorized use of content within a Photographer’s photo, we may, depending on the circumstances and the party making the claim, apply the Digital Millennium Copyright Act (DMCA) procedures and our established processes for other intellectual property (IP) claims as outlined in this policy.

Our Actions

Pixleaks strives to act fairly and in accordance with the principles of our community. However, we do not provide legal advice, and we are not authorized to issue legally binding judgments, as we are not a court of law.

Pixleaks may review content submitted to our platforms (such as Author photography) for quality purposes. During such reviews, potential issues regarding the rights of third parties or violations of our terms may be identified. In such cases, we may notify the Photographer of the potential issue. Nevertheless, Pixleaks is not obligated to review content for compliance with copyright or other legal matters.

Accordingly, users should not assume that Pixleaks has verified the existence or ownership of any copyright or other intellectual property rights in Photographer photos. The mere presence of a photo on the Pixleaks Online Platforms does not imply that copyright or other IP rights have been cleared or verified.

Additional Measures Pixleaks May Take

Intellectual property infringement can carry serious consequences, including potential legal action against infringers. Pixleaks User Terms explicitly prohibit the unauthorized use of content by any user of the Pixleaks Online Platforms. Nothing in this policy limits Pixleaks’ right to pursue any other remedies available to address suspected infringement.

If a Photographer receives multiple valid DMCA takedown notices or other valid IPR notices, or if we determine that the Photographer is in breach of Pixleaks User Terms, we may permanently disable the Photographer’s account. Other violations that may result in account termination include, but are not limited to:

  • Uploading photography that are not the Photographer’s original creation, or uploading without a license or other permission from the copyright holder to upload these photographs; or

  • Uploading photorealistic images of people that are derived with help of Ai generation.
